These terms govern the web design, automation and related services provided by ByRocket, operated by Jesse Kill, based in Wellington, New Zealand. By engaging our services, you agree to these terms.
Services and pricing
ByRocket provides custom websites, lead automations and related digital services for New Zealand trade businesses. Our core offering is:
- Lift-off: $350 NZD per month for a hand-coded website plus the automation system (instant lead follow-up, missed-call text-back, review funnel, one-click campaigns, on-site SEO). No setup fee, no fixed-term contract, cancel any time.
- Add-ons: optional services quoted separately, including Daily Social ($600/mo), Social + Drone Day ($1,000/mo), Holly the AI receptionist (from $3,000 set-up) and Custom AI integrations (from $6,000).
Prices are in New Zealand Dollars. We are not currently GST registered; when GST registration applies, prices may be adjusted and you will be notified in advance. Custom quotes for work outside our standard offering are confirmed in writing before work begins.
How it works
Our standard process is:
- 1. Enquiry: you submit your details via our website form.
- 2. Call and intake: we run a short call and send a questionnaire to gather your details and preferences.
- 3. Build: we design and build your website and wire up the automations, typically within 7 to 10 business days.
- 4. Launch: we walk you through it on a launch call, go live, and hand over access.
- 5. Ongoing: your monthly plan keeps the site hosted, managed and the automations running.
Payment terms
Payments are processed securely through Stripe. The monthly plan is billed in advance each cycle. Your card details are handled entirely by Stripe and are never stored on our servers.
One-off work and add-ons are quoted and invoiced separately, and confirmed before work begins.
Revisions and scope
Your build includes a round of revisions on the brand direction and a review round on the initial build. A "revision" means changes to the existing design direction, such as colour adjustments, text changes or layout tweaks. It does not include a complete redesign or significant scope changes.
Additional revisions or scope changes beyond what is included may incur extra charges, which will be communicated and agreed before any additional work begins.
Intellectual property
Your content: you retain full ownership of all content you provide, including text, images, logos and branding materials.
Your website: while on an active plan you have full use of your website. On request we will hand over your site files and code so you can host or transfer your site.
Portfolio rights: we may display your completed website in our portfolio, case studies and marketing, unless you request otherwise in writing.
Third-party assets: any stock images, fonts or third-party tools used will be subject to their respective licences. We ensure assets used are properly licensed for your use.
Cancellation
No lock-in: you can cancel your monthly plan at any time. Your plan continues until the end of the current paid month.
Fees already paid: monthly fees already paid for the current cycle are non-refundable, as the service has been provided for that period.
Your site: on cancellation we will provide your final website files and code so you can host it elsewhere. Hosting, the automations and ongoing management end when the plan ends.
Any refunds that do apply are processed back to the original payment method via Stripe.
Consumer guarantees
Under the New Zealand Consumer Guarantees Act 1993, our services come with guarantees that cannot be excluded. These include that services will be carried out with reasonable care and skill, will be fit for the purpose communicated to us, and will be completed within a reasonable time.
If our services do not meet these guarantees, you may be entitled to a remedy. Nothing in these terms limits or excludes any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
Limitation of liability
To the maximum extent permitted by New Zealand law:
- Our total liability for any claim arising from our services is limited to the amount you paid us for those services.
- We are not liable for any indirect, consequential or incidental damages, including loss of revenue, data or business opportunities.
- We are not responsible for downtime, data loss or issues caused by your hosting provider, domain registrar or third-party services after handover.
This limitation does not apply to any rights you have under the Consumer Guarantees Act 1993 that cannot be excluded by law.
Your responsibilities
So we can deliver your project on time and to a high standard, you agree to:
- Provide accurate and complete information during the intake process.
- Respond to communications and review requests in a timely manner.
- Ensure any content, images or materials you provide do not infringe third-party intellectual property rights.
- Not use the website we build for any unlawful purpose.
Delays in providing feedback or content may extend the project timeline beyond the estimate.
Dispute resolution
If a dispute arises, please contact us first at office@byrocket.co.nz so we can try to resolve it directly.
If we cannot reach a resolution, either party may refer the matter to mediation. If mediation is unsuccessful, the dispute will be subject to the exclusive jurisdiction of the New Zealand courts. These terms are governed by the laws of New Zealand.
Changes to these terms
We may update these terms from time to time. Any changes will be posted on this page with an updated date. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
